TERMS AND CONDITIONS OF SALE
1. You must be registered and issued a bidder number to bid. Registration will begin at 8:00am on Saturday, Nov. 15, 2025. Payments can be made in cash, cashier’s check, or certified funds. Final payment may also be made by credit card, up to a maximum of $2,500. An additional 3% service fee will be applied.
2. All persons acknowledge to have full knowledge of these “Terms and Conditions of Sale” and agree to be bound thereby. PLEASE NOTE: All terms and conditions will be strictly adhered to and if you are not able or unwilling to comply with the stated terms and conditions, PLEASE DO NOT BID. The auctioneer reserves the right to add one or more to the following “Terms and Conditions of Sale” by announcement at the sale. No employee is authorized to alter these terms. If the purchaser fails to comply with any of the stated and printed “Terms and Conditions of Sale” included but not limited to full payment, method of payment and removal of purchased goods, the auctioneer at his option may declare the purchaser in default and retain all monies paid as liquidated damages.
3. All vehicle titles are guaranteed, and a $1,000 cash deposit and signed purchase agreement is required at conclusion of the bidding on the Motorhome. A $300 cash deposit is required at conclusion of bidding on the 2016 Chevy Colorado, 2004 Nissan Pickup, and 1936 Chevy. Full payment to be made in CASH, CASHIERS CHECK, CERTIFIED FUNDS. NJ PERSONAL CHECKS OR BUSINESS CHECKS WILL ONLY BE ACCEPTED WITH THE APPROVAL OF THE AUCTIONEER. Wire transfers will be accepted and is the preferred payment method. Credit cards will be accepted up to a maximum of $2,500. All checks are to be made out to “Peter Costanzo Auctioneers”.
4. All C.O.D. balances must be paid IMMEDIATELY at the conclusion of the auction. Any open invoice balances must be paid no later than Saturday, November 15, 2025 – WITHIN A 2 HOUR LIMIT AFTER THE CONCLUSION OF THE AUCTION, OR BY SPECIAL AGREEMENT WITH THE AUCTIONEER.
5. PREVIEW: Purchasers may inspect the merchandise and are urged to do so on FRIDAY, NOVEMBER 14 from 1:00 PM to 4:00 PM, & from 8am to 9am Saturday morning of auction. The auctioneer and sellers make no warranty as to the condition of the merchandise. All goods are sold “AS IS” and “WHERE IS” and all sales are FINAL. PLEASE INSPECT ALL MERCHANDISE PRIOR TO BIDDING.
6. REMOVAL OF ITEMS: There will be NO REMOVAL DURING THE AUCTION. Items may be removed auction day at the conclusion of the auction. All items must be removed by MONDAY, NOVEMBER 17, BY 12:00PM, UNLESS OTHER ARRANGEMENTS ARE MADE AND AGREED UPON WITH THE AUCTIONEERS.
7. Any items not picked up in the allotted removal time will be subject to a storage fee of $50 per day per item, or considered abandoned.
8. Purchasers must remove the merchandise from the premises at their own risk and liability. All purchases are made at the purchaser’s risk and the auctioneer is not responsible if all or any part is lost, stolen, damaged or destroyed from any cause. Auctioneer shall not be liable for non-delivery to the purchaser of any lots.
9. In the event of a billing error the buyer is obligated to pay any deficiency upon presentation of a corrected bill.
10. Auctioneer reserves the right to resolve any dispute regarding bids or bidders and WILL EXECUTE ANY ONLINE, PHONE AND/OR ABSENTEE BIDS. In addition to being offered in the Live Auction, the Motorhome is also being offered by Online Simulcast Bidding. Auctioneers may group or subdivide lots at his discretion for ease of sale.
11. Record of the sale is being kept by the auctioneer & bookkeeper and will be taken as final in the event of any dispute.
This sale is subject to a 15% buyer’s premium, with a $5.00 minimum. An additional 3% service fee is charged for credit card use.
All items will be sold in the order of the catalog unless changed by the auctioneer.
All items in catalog are subject to additions or deletions.
No merchandise will be released without a paid invoice.
Auctioneer reserves the right to reject any bid or bidder and auctioneer will determine bidding increments.
